Level Chinese (the “Service”) provides users with access to a rich collection of teaching resources via the Level Chinese website; it also provides student assessments via the online assessment system, masterytrack.org.  Level Chinese is a proud supporter of the Student Privacy Pledge to safeguard student privacy. This Privacy Policy applies to the Level Chinese service, and describes what information we gather from students and others who use the service, how we use that information, and what we do to protect it.

LEVEL CHINESE’S GUIDING PRINCIPLES FOR STUDENT PRIVACY

 

While more details are included below, following are the key guiding principles of our approach to student privacy:

 

  1. We collect and use personal information for educational purposes only.
  2. We will never sell personal information to third parties or accept third-party advertising within our services.
  3. We are committed to creating a secure online environment in which student data is appropriately safeguarded.

 

  1. HOW WE COLLECT AND USE YOUR INFORMATION

 

Level Chinese provides a web-based technology service that schools and students can use to assess and track mastery of learning objectives. Level Chinese also provides a repository of learning and practice resources that are aligned to each learning objective. In order to provide this service, we collect the following types of information:

 

  • School Data: We ask for certain information when a school partners with Level Chinese or corresponds with us online, including a name, school name, school district, email address and/or account name and password, phone number, message content, and information relating to the school’s information systems. We may also retain information provided by a school if the school sends us a message, posts content to our website or through our service, or responds to emails or surveys. Once a school begins using Level Chinese, we will keep records of activities related to the service. We use this information to operate and maintain our service, to analyze our service offerings and functionality, and to communicate with our schools and website visitors.

 

  • Student Data: Level Chinese may have access to personally identifiable information about students (“Student Data”) in the course of providing its services to a school, including name, grade level, gender, school, email address, account username and password, and academic achievement and usage data. We consider Student Data to be confidential and do not use such data for any purpose other than to provide the services on the school’s behalf. Level Chinese has access to Student Data only as requested by the school and only for the purposes of performing services on the school’s behalf.

 

  • Information collected through technology: We may automatically collect certain types of usage information when visitors view our website or use our service. We may send one or more cookies — a small text file containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and lets Level Chinese help you log in faster and enhance your navigation through the site. A cookie may also convey information to us about how you use the service. This information is used to track site performance and usage, and to help us make improvements to our services.

 

We do not accept advertising within our site or service, and do not build personal profiles of students other than for supporting authorized educational/school purposes.

 

We do not collect any information from students without consent. We do not collect, maintain, use or share student personal information beyond that needed for authorized educational/school purposes. We collect, use, share, and retain personal information only for purposes for which we were authorized by the educational institution, teacher or the parent/student.

 

  1. HOW WE SHARE YOUR INFORMATION

 

Level Chinese only shares personal information in a few limited circumstances, as described below:

 

  • We may share information with those that provide us with technology services (e.g. web hosting and analytics services), but strictly for the purpose of carrying out their work for us. We require these vendors to implement the commitments contained in the Student Privacy Pledge.

 

  • We may be required to share information with law enforcement or other third parties when compelled to do so by court order or other legal process, or to comply with applicable laws or regulations.

 

  • In the event of a change of control: If we sell, divest or transfer our business, we will not transfer personal information of our customers unless the new owner intends to maintain and provide the service as a going concern, and provided that the new owner has agreed to data privacy standards no less stringent than our own, including the commitments contained in the Student Privacy Pledge. In such case we will provide you with notice and an opportunity to opt-out of the transfer of personally identifiable Student Data.

 

In addition to the actions described above, Level Chinese may facilitate the sharing of Student Data with third parties, though only when instructed and authorized to do so on behalf of the school, and in a manner consistent with all applicable laws.

 

We do not rent or sell information for marketing or advertising purposes.

 

  1. HOW WE STORE AND PROTECT YOUR INFORMATION

 

We maintain a comprehensive security program that is reasonably designed to protect the security, privacy, confidentiality, and integrity of student personal information against risks – such as unauthorized access or use, or unintended or inappropriate disclosure – through the use of administrative, technological, and physical safeguards appropriate to the sensitivity of the information.

 

Storage and processing: Any information collected through the service is stored and processed in the United States. If you use our service outside of the United States, you consent to have your data transferred to the United States.

 

Keeping information safe: Level Chinese maintains strict administrative, technical and physical procedures to protect information stored in our servers. Access to information is limited to those employees who require it to perform their job functions. We use industry-standard encryption technology to safeguard the account registration process and sign-up information. Other security safeguards include but are not limited to data encryption, firewalls, and physical access controls to buildings and files.

 

  1. YOUR CHOICES ABOUT YOUR INFORMATION

 

Account information and settings: schools may update account information and modify services and settings by signing into the administrator account.

 

Access to Student Data: Student Data is provided and controlled by the schools. If you have any questions about reviewing, modifying, or deleting personal information of a student, please contact your school directly. We will assist the school in meeting its requirements to provide access to and correction of Student Data.

 

Deleting or disabling cookies: You may be able to disallow cookies to be set on your browser. Please look for instructions on how to delete or disable cookies and other tracking/recording tools on your browser’s technical settings. You may not be able to delete or disable cookies on certain mobile devices and/or certain browsers. For more information on cookies, visit www.allaboutcookies.org.

 

Retention of Student Data: We will not knowingly retain student personal information beyond the time period required to support the authorized educational/school purpose, or as authorized by the parent/student. Following termination or deactivation of a school account, any and all Student Data associated with the school will be deleted promptly. We may retain anonymized or aggregated data, including usage data, for analytics purposes.

  1. CHILDREN’S PRIVACY

 

Level Chinese does not knowingly collect any information directly from children under the age of 13 unless the school has obtained appropriate parental consent for the student to use the service. Please contact us at scott.ellis@learningaccelerator.org if you believe we have inadvertently collected personal information of a child under 13 without proper consent, so that we may delete such data as soon as possible.

 

  1. LINKS TO OTHER WEB SITES AND SERVICES

 

We are not responsible for the practices employed by websites, applications or services linked to or from our service. We recommend that the school review the privacy policies of other applications and services before allowing access to them through the service.

 

  1. CHANGES TO OUR PRIVACY POLICY

 

Level Chinese will not make material changes to this privacy policy without first providing prominent notice to the account holders and allowing them choices before data is used in any manner inconsistent with the previous terms. If we change the privacy policy in a material manner, we will provide at least 30 days notice so that you have sufficient time to evaluate the change. We will not make material changes to other policies or practices governing the use of student personal information that are inconsistent with our contractual requirements and applicable laws.
